Before 1878 women could not practice law in California. When Hastings College
of Law was created by Stats. 1877-8, p. 533, women were denied admission
thereto. Clara Shortridge Foltz overthrew both barriers. She authored the
legislative bill which changed C.C.P. 275 and thus enabled women to be
admitted — as she herself was on Sept. 4, 1878 — the first woman lawyer in
California. She applied for registration at Hastings, was denied, and thereupon
prosecuted — in propria ...

Passing the California bar was the least of the trials of aspiring attorney Clara
Foltz. "A woman's place is at home, unless it is as a teacher," chided one
prominent San Jose lawyer, who perhaps did not relish the prospect of a clever
competitor encroaching on his high-income turf. "If you would like a position in
our public schools I will be glad to recommend you . . . . " As a financially
strapped divorcee, however, Foltz was more interested in feeding her own five
children than educating ...

Denied admission by directors who apparently believed that women might
practice, but should not learn, the law, the two women sued, representing
themselves. They prevailed in the trial court and eventually in the California
Supreme Court. The decision came too late for Foltz, however, who was already
a busy lawyer supporting her family. Foltz practiced law continuously for fifty
years, but she always regretted her lack of formal training and worked to make
the study of law easier for ...

Clara Foltz stood all night in a roomful of roses receiving congratulations for this
victory - as she always told the story. Soon, the new voters wanted a prosecutor
from their own ranks. Clara Foltz was a natural choice for the first female Deputy
District Attorney in Los Angeles. For several years here in Los Angeles, she put
out a magazine called The New American Woman, and in it she published a
column: "The Struggles and Triumphs of a Woman Lawyer." The first installment
promised ...

The prosecutor in Wheeler asked Clara Foltz to join him, not because she was
yet very distinguished, but because she was a woman. Evidently, he bought the
arguments about the effect women lawyers had on juries. And so did the Wheeler
defense lawyers, who sought the services of the only other woman lawyer in the
state: Laura Gordon. When the case came to trial, women spectators vied with
men for the best seats in the courtroom, particularly annoying to gentlemen who
